Terms and Conditions
These Terms govern access to and use of Wistudi, including creating, publishing, sharing and interacting with content on the Platform.
1. About Wistudi
Wistudi is operated by Wistudi Publishing Ltd, a company registered in England and Wales under company number 17458982. Our registered office is 128 City Road, London, United Kingdom, EC1V 2NX.
In these Terms, “Wistudi”, “we”, “us” and “our” mean Wistudi Publishing Ltd. “Platform” means the Wistudi websites, applications, services, APIs, content builders, interactive video features, learning tools and related services. “User” or “you” means any person accessing the Platform. “Creator” means a User who creates, uploads, imports, publishes, embeds, adapts or shares content. “Learner” means a User who accesses or participates in learning content. “User Content” means content uploaded, created, submitted, imported, embedded, linked, published or shared by a User.
2. Agreement and related policies
By creating an account, accessing Wistudi, purchasing or receiving credits, uploading content, publishing content, or otherwise using the Platform, you agree to these Terms.
These Terms should be read together with the Wistudi Privacy Policy, Cookie Policy, Credit Usage Policy, Template Publishing and Remix Terms, and any other policy expressly stated to form part of your agreement with Wistudi. Rules on prohibited content and conduct are set out in Section 17, and copyright complaints and takedowns are addressed in Section 20.
If you purchase, receive or use Wistudi credits, the Credit Usage Policy also applies and forms part of these Terms where credits are relevant.
If you submit content for use as a public Template, publish an approved Template, or use or remix a Template made available through Wistudi, the Template Publishing and Remix Terms also apply.
3. Eligibility and age
You must be at least 16 years old to independently create a Wistudi account, purchase credits or enter into a paid agreement with Wistudi. By registering independently, you confirm that you are legally able to accept these Terms and that the information you provide is accurate.
Users under 16 may only access Wistudi through an approved parent-, guardian- or other lawful supervised arrangement where the required consent and authority have been obtained. Wistudi may apply age-appropriate privacy and feature restrictions.
4. Accounts and security
You must provide accurate information, keep your account details current, protect your password and access credentials, and promptly notify Wistudi if you suspect unauthorised access.
- You must not impersonate another person or use another person's account without permission.
- You must not create multiple accounts to evade restrictions, manipulate rewards or abuse the Platform.
- You must not sell, transfer, rent or trade your account.
- You are responsible for activity carried out through your account unless applicable law provides otherwise.
5. Platform features
Wistudi provides tools for creating, publishing, sharing and participating in digital learning experiences, including Flows, XP Videos, Blocks, activities, resources, assessments, reports and other features that may change over time.
Access to a feature may depend on account status, age, permissions, content status, available credits, storage, geographic availability, technical compatibility or other Platform requirements. Wistudi does not guarantee that every feature will always be available to every User.
6. Ownership, creator attribution and identification of User Content
Ownership of original User Content
You retain ownership of the original User Content you create and upload. Uploading, publishing, listing or sharing content on Wistudi does not transfer ownership of that content to Wistudi.
Creator attribution and identification
Where Wistudi displays, lists or shares published User Content through the Platform, Wistudi may identify the Creator or publishing organisation using the applicable account, organisation, profile, display name, author information or other Creator information associated with that content. Subject to the relevant feature, publishing setting and these Terms, content published by a Creator is intended to remain identifiable on Wistudi as content created or published by that Creator or organisation.
Other Users must not remove attribution from, falsely claim authorship of, or misrepresent the source or Creator of another User's content except where a Wistudi feature expressly permits a different attribution treatment.
Template and remix exception
The principal exception is where the Creator expressly chooses to submit or make content available as a Wistudi Template or through another Wistudi feature that expressly permits reuse or remixing. In that case, the Creator grants the reuse and remix permissions applicable to that feature. A User who validly creates a remix may publish the resulting version through their own account and may be displayed as the primary Creator or author of that remixed version, while ownership of the original Creator's underlying original material is not transferred to the remixing User.
Template-specific ownership, reuse, remixing and attribution rules are governed by the Original ownership, Licence granted to Users who remix a Template, Ownership of remixed content and Attribution and author display provisions of the Template Publishing and Remix Terms.
Copies and backups
You are responsible for keeping independent copies of important content. Wistudi is not intended to be the only permanent backup of your files or materials.
7. Licence you grant to Wistudi
By uploading, creating, submitting, importing or publishing User Content, you grant Wistudi a worldwide, non-exclusive, royalty-free licence to host, store, copy for operational and backup purposes, display to authorised Users, process through Platform features, format, resize, encode, transcode, create technical previews, distribute according to your sharing settings, generate activity records and analytics, moderate the content, provide support, secure the Platform and otherwise operate Wistudi.
This licence is limited to what is reasonably required to operate, maintain, secure, provide and improve the Platform. It does not transfer ownership of your User Content to Wistudi.
Wistudi may allow service providers acting on our behalf to process User Content only to the extent reasonably necessary to provide infrastructure, hosting, security, communications, support or other Platform services, subject to applicable contractual and privacy obligations.
8. Publishing, sharing and distribution
Publishing or sharing content does not give other Users ownership of that content. A public, private or other Wistudi share link provides access only in accordance with the Creator's sharing settings and does not by itself grant a right to copy, download, reproduce, sell, sublicense, adapt, republish or distribute the underlying content.
Unless Wistudi expressly provides a reuse feature and the Creator has authorised that use, Users must not copy, scrape, download, reproduce, redistribute, sell, sublicense, republish, remove attribution from, or commercially exploit another Creator's content without permission or another lawful basis.
If you choose to list content publicly in the Wistudi Marketplace, you authorise Wistudi to display that listing publicly within Wistudi, include it in Marketplace search, browsing and recommendations, display its title, thumbnail, description and Creator information, and promote it through Wistudi's own services and communications. Public listing in the Marketplace does not automatically give other Users remix or redistribution rights beyond the permissions expressly granted under Free Marketplace Content or another applicable Wistudi reuse programme.
By publishing content, the Creator confirms that they created the content or have sufficient rights, licences, permissions or lawful authority to publish it through Wistudi; that included third-party material is used lawfully; and that they understand the permissions associated with the publishing option selected. Different publishing options may grant different access or reuse rights, including the permissions described under Free Marketplace Content and the separate Template Publishing and Remix Terms.
9. Limits of content protection
Wistudi may provide access controls, sharing settings, moderation systems and other reasonable protections, but no online platform can guarantee that authorised recipients or third parties will never screenshot, screen-record, copy, reproduce or misuse content.
Wistudi does not guarantee prevention of copyright infringement or unauthorised copying. Rights holders remain responsible for protecting and enforcing their intellectual-property rights, while Wistudi may investigate reports and restrict or remove content in accordance with Copyright complaints and takedowns, these Terms and applicable law.
10. Templates and remixing
Content is not automatically available for remixing merely because it has been published on Wistudi or publicly listed in the Marketplace. Remixing rights apply only where content has been approved and made available through a Wistudi Template programme or another feature that expressly permits reuse.
The rights and responsibilities relating to Template submission, remixing, re-authoring, redesigning, redistribution, attribution, removal requests and Template rewards are governed by the Template Publishing and Remix Terms.
11. Free Marketplace Content
Wistudi may allow Creators to make eligible content available through the Wistudi Marketplace as Free Content. Content identified as Free Content is made available to Users without a separate charge for access to that content.
Permission granted by the Creator
By choosing to list content as Free Content in the Wistudi Marketplace, the Creator authorises Users of Wistudi to access and use that content for legitimate teaching, education, training, tutoring, workshops, courses, seminars, presentations and other comparable educational, instructional or professional activities.
This permission includes use of Free Content as part of paid teaching, training or professional activity. A User may charge learners, participants, clients or attendees for a class, course, workshop, seminar, tutoring session, presentation, coaching session or other service in which the Free Content is used, including where payment is collected outside Wistudi through the User's own booking service, invoice, payment gateway or other external arrangement.
Wistudi is not a party to those external transactions and does not process, control, monitor or receive those payments unless Wistudi expressly provides a payment feature for that purpose. Wistudi is not responsible for external payments, refunds, cancellations, tax or invoicing obligations, customer disputes, pricing decisions, promises made by the User, or third-party payment providers used by the User.
Charging for a teaching, training, educational or professional service in which Free Content is used does not, by itself, constitute resale of the Free Content.
Ownership and limits on reuse
Listing content as Free Content does not transfer ownership of the content. The original Creator continues to own their original content and any intellectual-property rights they hold in it.
Unless additional permission is expressly provided by the Creator or through another Wistudi feature, including the Template programme, Free Content may not be sold or licensed as a standalone product, resold or redistributed as a competing content resource, claimed as another User's original work, sublicensed to third parties, removed from Wistudi and commercially repackaged for resale, or materially adapted or remixed where no separate remix permission has been granted.
Wistudi promotion and indirect commercial benefit
By listing content as Free Content, the Creator authorises Wistudi to display, feature, recommend, categorise, index, preview, showcase and promote that content within the Platform and through Wistudi's website, communications, newsletters, social media, marketing and promotional activities. For these purposes, Wistudi may use reasonable information associated with the content, including its title, description, thumbnail, preview images or video, short excerpts, category information and Creator display information where applicable.
Wistudi will not charge Users a separate purchase price for access to content while it is specifically listed as Free Content. However, the Creator acknowledges that the availability, promotion and accumulation of Free Content may contribute to Platform traffic, registrations, engagement, retention, Marketplace activity, brand awareness, use of other Wistudi services, credit purchases or other lawful commercial activity.
Any such indirect commercial benefit to Wistudi does not constitute the sale or direct monetisation of the Creator's Free Content. The Creator does not acquire a right to royalties, revenue share, commission, licence fees or other payment merely because their Free Content contributes to Platform growth, promotion, engagement or revenue, unless Wistudi and the Creator expressly agree otherwise in writing.
Removal or change of Marketplace status
A Creator may remove or unpublish Free Content using controls Wistudi makes available, subject to these Terms and any rights already lawfully exercised by Users before removal. Removing Free Content from the Marketplace does not normally make previous lawful teaching, training or presentation use unlawful.
Wistudi may remove, restrict, suspend or stop promoting Free Content where reasonably necessary for legal, copyright, privacy, safeguarding, security, quality, technical or policy reasons. Copyright and rights complaints are handled under Copyright complaints and takedowns.
12. Your responsibility for content
You are responsible for content you upload, import, embed, publish or share. You confirm that you created the content or have sufficient rights to use it in the way you choose on Wistudi.
- You must have permission for included media, personal information and third-party materials where permission is required.
- You must comply with copyright, trademark, privacy, publicity, database, confidentiality and other applicable rights.
- You must have authority to share content with its intended audience and to commercialise it where commercial use is enabled.
- The fact that content is publicly available elsewhere does not automatically mean that you may copy, adapt, download, monetise or republish it.
Where a Creator chooses a publishing option that grants broader reuse rights, including Free Marketplace Content or the Template programme, the Creator confirms that they have sufficient rights to grant those broader permissions.
13. External and third-party content
Wistudi may allow links, embeds or integrations with third-party services such as YouTube, Vimeo, cloud-storage services, conferencing services and other external products. External content remains subject to the rights of its owner and the terms, policies, availability and technical restrictions of the external provider.
You must use official links, embeds, players or authorised APIs where required and must not bypass access controls, remove provider branding, manipulate engagement, scrape unauthorised data or claim ownership of external content.
Wistudi is not responsible for third-party outages, removed content, changed APIs, account restrictions, advertising, third-party data practices, third-party payment failures or changes to external service terms.
14. Learner submissions and personal information
Learners retain ownership of their original submissions. Wistudi may process and display learner submissions to authorised Creators for teaching, assessment, grading, feedback, progress tracking, reporting, safeguarding and Platform administration.
Creators must not use learner submissions or personal information for unrelated marketing, publicity, AI training or other unrelated commercial purposes without an appropriate lawful basis and any required consent.
15. Educational content, scores and results
Wistudi provides tools for learning, assessment and reporting, but does not guarantee that User-created content is accurate, appropriate for every learner, professionally qualified, formally accredited or suitable as the sole basis for a high-impact educational decision.
Creators are responsible for reviewing their content, configuring correct answers and scoring, setting appropriate requirements, reviewing manual submissions and correcting grading errors.
16. AI-assisted features
Wistudi may provide AI-assisted tools for creation, recommendations, feedback or other functions. AI-generated output may be incomplete, inaccurate, biased, unsuitable, similar to existing material or incorrectly attributed.
Users must review AI-generated output before publishing or relying on it and remain responsible for factual accuracy, suitability, confidentiality and third-party rights. AI output should not be used as the sole basis for a high-impact decision.
Any use of personal data or User Content for AI processing or model training will be addressed through the applicable Privacy Policy and product controls.
17. Prohibited content and conduct
You must not use Wistudi to upload, create, publish or share unlawful content; material that infringes third-party rights; content that exploits or endangers children; unlawful hate, violent-extremist or sexual content; malicious software; fraud; impersonation; serious threats; unlawful weapons or drug promotion; private personal information disclosed without authority; or other content that presents a serious legal, safety or security risk.
You must not bypass Platform controls, circumvent credit or publishing requirements, introduce malware, scrape Platform data without permission, manipulate scores or activity, abuse complaints systems, test vulnerabilities without authorisation, send spam, or use unauthorised extraction to build a competing service.
18. Moderation and enforcement
Wistudi may use human review, automated tools, User reports and other reasonable processes to identify content or conduct that may violate these Terms or applicable law. Wistudi is not required to pre-approve every item of User Content.
We may restrict access, remove content from public areas, suspend new sharing or publishing, request changes, preserve evidence, suspend or terminate accounts, or report matters to relevant authorities where required. Immediate action may be taken where necessary to address child safety, illegal content, fraud, security risks, serious infringement or serious harm.
19. Moderation appeals
Where an appeal is available, a User may normally appeal an eligible moderation decision within 14 days of notice by providing the affected content, the decision being challenged, the reason for the appeal and relevant supporting evidence.
Wistudi may reject repeated, abusive, misleading or late appeals, or appeals concerning content Wistudi is legally required to remove.
20. Copyright, rights complaints and takedowns
Wistudi respects the intellectual-property rights of Creators, Users and third parties. A copyright owner or authorised representative may report content they reasonably believe infringes their rights by contacting support@wistudi.com.
A report should provide sufficient information to identify the protected work, the disputed Wistudi content, the rights claimed, the complainant's name and contact information, the basis of the complaint, and relevant supporting evidence. Where a report is submitted by a representative, Wistudi may request information showing their authority to act for the rights holder.
Copyright and rights complaints must be submitted honestly and in good faith. Users must not knowingly submit false, fraudulent, misleading or abusive infringement claims.
Investigation and temporary restrictions
When Wistudi receives a credible copyright, intellectual-property, privacy or other rights complaint, Wistudi may place the disputed content under review and may temporarily prevent new Users from accessing it, remove it from Discover, search, recommendations or the Marketplace, disable new sharing links, prevent further publication, remixing or duplication, or suspend its availability through the Template programme.
Wistudi may ask the affected Creator to provide evidence of authorship, ownership, licence, written permission, public-domain status, applicable Marketplace permissions, applicable Template permissions, or another lawful basis for use.
Unless Wistudi reasonably determines that immediate removal is necessary for legal, copyright, privacy, safeguarding, security or serious-harm reasons, existing active learners who had already begun accessing the affected content may normally continue to access their existing learning experience while the matter is under review. Allowing that temporary access does not constitute a determination that the content is lawful or non-infringing.
Investigation period and removal
Wistudi will aim to review reported content within a reasonable period. Depending on the complexity of the complaint, the evidence required and responses from the parties, investigation and final removal of disputed content may take up to 30 days from the time Wistudi has sufficient information to investigate the matter. Wistudi may act sooner where the issue is clear or urgent.
Where Wistudi reasonably determines that content should be removed or restricted, Wistudi may remove it from public availability, disable further access or sharing, remove it from Discover, the Marketplace or the Template Library, restrict further publishing by the affected User, preserve relevant records, or take other appropriate Platform action.
Where legally and practically appropriate, Wistudi may preserve learner progress records, submissions, grades or reports even where access to the underlying content is discontinued. Wistudi may immediately disable access for existing learners where continued access could reasonably expose Wistudi, Users or third parties to legal liability, infringement, safeguarding concerns, privacy risks, security risks or serious harm.
Creator response, restoration and repeat infringement
Where appropriate, Wistudi may notify the affected Creator and give them an opportunity to respond. Wistudi may restore or continue to make content available where a complaint is withdrawn, insufficiently supported, resolved between the parties, or where the Creator provides sufficient evidence of a lawful basis for use.
Wistudi is not required to determine complex ownership, licensing or contractual disputes and may keep disputed content restricted until the parties resolve the matter or a court, regulator or other competent authority provides appropriate direction.
Repeated or serious infringement may result in content removal, publishing restrictions, suspension or termination of an account. Wistudi may also restrict or terminate Users who repeatedly submit knowingly false infringement claims or otherwise misuse Wistudi's rights-protection procedures.
Wistudi's complaint and takedown process does not make Wistudi responsible for privately enforcing a Creator's intellectual-property rights outside the Platform. Rights holders remain responsible for determining how to protect and enforce their rights outside Wistudi.
21. Wistudi intellectual property
Wistudi and its licensors own the Platform and its original software, source code, architecture, interface design, branding, logos, documentation, databases and other proprietary materials. These Terms do not transfer ownership of Wistudi intellectual property to you.
Wistudi grants you a limited, revocable, non-exclusive and non-transferable right to use the Platform in accordance with these Terms.
22. Feedback
If you voluntarily provide product ideas, comments, suggestions or feedback, you permit Wistudi to use that feedback without payment or restriction. This does not include ownership of your User Content or confidential information submitted under a separate confidentiality obligation.
23. Publishing and versioning
Creators are responsible for reviewing content before publication. Wistudi may require completed settings, supported formats, sufficient credits, moderation approval or other publishing requirements.
Published content may use version controls. Wistudi does not guarantee that every edit can be applied to a version already being used by learners, particularly where doing so would affect progress, scores, attempts or submissions.
24. Credits, purchases and refunds
Credits are internal Platform units used for selected publishing actions, Blocks or features. Credits have no cash value, cannot be resold and may not be transferred between personal accounts unless Wistudi expressly provides an authorised transfer feature.
Purchased credits are generally non-refundable. Credits already used for a completed publication, feature or other confirmed credit-based action are not refundable or restorable merely because a User later deletes, archives, unpublishes, replaces or stops using the content.
Limited exceptions may apply for duplicate or incorrect payments, credits not delivered, verified Wistudi technical failures, refunds required by law, or other exceptional circumstances expressly accepted by Wistudi. Full rules are set out in the Credit Usage Policy.
25. Payments and taxes
Before a paid transaction, Wistudi will display the applicable price or credit amount and other information required by law. Payments may be processed by authorised third-party payment providers, whose own terms and privacy policies apply.
Prices may be displayed inclusive or exclusive of taxes depending on location. Users are responsible for providing accurate payment and tax information.
26. Privacy, data collection, security and data handling
Wistudi processes personal information and other Platform data in accordance with applicable data-protection law and the Wistudi Privacy Policy. The Privacy Policy provides more detailed information about categories of personal information, purposes of processing, legal bases, disclosures, international transfers, retention and individual rights.
Information Wistudi may process
Depending on how the Platform is used, Wistudi may process account and profile information, contact information, Creator and Learner information, User Content and learner submissions, learning activity and progress, scores, attempts, feedback and reporting information, publishing and sharing activity, Marketplace and Template activity, credit and transaction records, technical and device information, security and usage records, support communications, moderation and copyright records, and information generated through use of Platform features.
Wistudi may process this information where reasonably necessary to create and manage accounts, authenticate Users, provide and secure the Platform, deliver authorised content, support teaching and assessment, record progress, provide reports and support, process permitted transactions, investigate technical issues, detect fraud or misuse, moderate content, investigate rights complaints, maintain backups, analyse Platform performance, improve functionality, communicate important service information, and comply with legal, regulatory, contractual, safeguarding or security obligations.
Confidentiality and access to User data
Wistudi does not make private, sensitive, account, learner, activity, progress, assessment, transaction or other non-public personal information available to the general public or to unrelated Users of the Platform.
A User may access information relating to another User only where that information has been made available through an authorised Wistudi feature, relationship, permission or sharing setting. Access through an account does not give a User a general right to obtain additional private information about another person beyond information already made available to them through the Platform.
Wistudi is not required to disclose private, sensitive, internal, security-related, confidential or other non-public information about another person merely because a User requests it. Nothing in these Terms limits a person's lawful right to request access to personal information that Wistudi holds about that person. Wistudi may verify identity or authority and may redact, restrict or withhold information about other people, confidential information or security-sensitive information to the extent permitted or required by law.
Wistudi may disclose or provide access to personal information only where reasonably necessary and permitted by law, including where the User has chosen to share it, where access is required to provide an authorised Platform feature, where an authorised Creator requires appropriate Learner information for legitimate teaching, assessment, reporting, safeguarding or support purposes, where an authorised service provider processes information on Wistudi's behalf, where disclosure is required by law or a competent authority, or where reasonably necessary for security, fraud prevention, safeguarding or protection from serious harm.
Security
Wistudi uses reasonable technical and organisational measures intended to protect personal information, User Content and Platform data against unauthorised access, loss, misuse, alteration or disclosure. No online platform, transmission method or storage system can guarantee absolute security.
Users are responsible for protecting passwords, login credentials and account access and should promptly notify Wistudi if they suspect compromise. Wistudi may restrict or suspend access where reasonably necessary to investigate or respond to a security incident.
Service providers and international processing
Wistudi may use authorised service providers for hosting, infrastructure, storage, communications, analytics, payments, security, support and other Platform functions. Those providers may process information only to the extent reasonably necessary to provide the relevant service and subject to applicable contractual, confidentiality, privacy and security obligations.
Wistudi and its authorised service providers may process or store information in countries other than the country in which a User is located. Where required, Wistudi will use appropriate legal, contractual or organisational safeguards for international transfers of personal information in accordance with applicable law.
Data retention and storage
Wistudi may retain personal information, User Content, Platform activity records and related information for as long as reasonably necessary for the purposes for which the information was collected or otherwise lawfully processed. Retention periods may differ according to the type of information, the reason it is used and applicable legal, contractual, operational and security obligations.
Wistudi may retain information where reasonably necessary to operate and maintain an account; provide access to published content and learning experiences; maintain learner progress, submissions, grades and reports; maintain records of publishing, sharing, Marketplace and Template permissions; document credit, payment and transaction activity; provide support; investigate technical issues, fraud, misuse, security incidents, copyright, privacy or moderation complaints; preserve evidence relating to disputes or legal claims; comply with tax, accounting, regulatory or other legal obligations; meet safeguarding obligations; maintain reasonable backups and disaster-recovery systems; or establish, exercise or defend legal rights.
Wistudi will not retain personal information indefinitely merely because it may be useful in the future. Where information is no longer reasonably required for a lawful purpose, Wistudi may delete, anonymise or otherwise securely dispose of it in accordance with its retention practices and applicable law.
Account closure, deletion and backups
Closing an account or deleting content does not necessarily result in the immediate deletion of every record associated with that account. Some information may continue to be retained where reasonably necessary for legal, accounting, tax, security, fraud-prevention, contractual, backup, safeguarding, dispute-resolution, moderation or regulatory purposes.
Information may remain temporarily in system backups, security logs, transaction records, moderation records or disaster-recovery systems until those records are overwritten or deleted through Wistudi's normal retention processes. Where Wistudi is legally required to retain information for a specified period, that information may be retained for that period even after an account has been closed or the underlying content has been deleted.
Wistudi will establish appropriate retention periods or retention criteria for different categories of information and will review retained personal information where appropriate. More detailed retention information is provided in the Wistudi Privacy Policy.
AI and automated features
Where personal information or User Content is processed through AI-assisted features, that processing will be governed by the applicable Privacy Policy, product controls and any additional notice presented through the relevant feature.
27. Platform availability and changes
Wistudi aims to provide a reliable service but does not guarantee uninterrupted availability. The Platform may be affected by maintenance, updates, security work, hosting failures, internet problems, third-party outages, external API changes or events outside Wistudi's reasonable control.
Wistudi may modify, replace, restrict or discontinue features. Material changes affecting paid services will be communicated where reasonably required.
28. Beta and preview features
Features marked Beta, Preview, Prototype, Experimental or Coming Soon may be incomplete, change without notice, contain errors, have limited support or be withdrawn. Users should not rely on experimental features for critical educational, safeguarding, financial or legal decisions.
29. Suspension, termination and account closure
Wistudi may suspend, restrict or terminate an account where reasonably necessary because of a serious or repeated breach of these Terms, illegal activity, copyright infringement, child-safety concerns, fraud, unpaid valid fees, security risks, harassment, misuse of personal information or attempts to disrupt the Platform.
You may close your account through available controls or by contacting Support. Before closure, you should export content or information you need. Account closure may affect content, progress, reports, shared links, credits and stored files. Data may be retained where required for legal, security, backup, safeguarding or contractual reasons.
30. Disclaimers
Wistudi is provided on an “as available” basis. To the extent permitted by law, Wistudi does not guarantee uninterrupted access, error-free features, the accuracy of User Content, continued availability of external content, continuation of third-party integrations, a particular learning result or that content will never be lost.
Nothing in these Terms excludes warranties, statutory rights or liabilities that cannot legally be excluded.
31. Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, or any liability that cannot legally be limited.
To the extent permitted by law, Wistudi is not responsible for losses caused by User Content, unauthorised external content, third-party services, external-provider content removal, User configuration errors, inaccurate Creator grading, unauthorised copying by another User, or events outside Wistudi's reasonable control.
For business use, Wistudi will not be liable for indirect or consequential loss including loss of profit, revenue, business, opportunity, reputation, anticipated savings or data that was not separately backed up, to the extent permitted by law.
32. Changes to these Terms
Wistudi may update these Terms to reflect new features, legal requirements, security needs, commercial changes, Platform improvements or third-party requirements. The updated Terms will display a revised “Last updated” date.
Where a change materially affects Users, Wistudi may provide notice by email, Platform notification, account message or website notice. Further consent will be requested where required by law.
33. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes, subject to mandatory rights available to consumers in their country of residence.
34. General provisions
If part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right. You may not transfer your account or contractual rights without Wistudi's written permission.
Wistudi may transfer its rights and obligations as part of a merger, acquisition, financing, restructuring or sale of its business. These Terms do not create a partnership, employment relationship, agency or joint venture between Wistudi and a User.
