Template Publishing and Remix Terms
These Terms apply when a Creator gives Wistudi permission to publish a Flow, XP Video or other eligible content as a public Template for other Users to use and remix.
1. Scope of these Terms
These Terms apply specifically to content submitted, approved, published, accessed, used or remixed through the Wistudi Template Library or another Wistudi feature that expressly makes content available as a Template.
If there is a conflict between these Template Terms and the general Wistudi Terms and Conditions in relation to Templates, these Template Terms apply to the extent of that conflict.
2. Express permission to publish as a Template
A Creator must expressly choose to submit eligible content for Template review or otherwise give Wistudi clear permission to make that content available as a public Template.
Submitting content does not guarantee approval. Wistudi may approve, reject, request changes to, delay, restrict or decline a Template submission at its discretion, including for quality, safety, technical, rights or policy reasons.
Once a Template is approved and made available publicly, the licences and permissions granted under these Terms take effect.
3. Original ownership
The original Creator retains ownership of the original content they own. Submitting or approving a Template does not transfer ownership of that original content to Wistudi.
The Creator understands, however, that the purpose of the Template programme is to permit other Users to create their own versions from the Template. The licences granted below are therefore broader than the permissions that normally apply to ordinary published Wistudi content.
4. Licence granted to Wistudi
By submitting content and allowing it to be approved as a Template, the Creator grants Wistudi a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, make available, technically adapt, format, preview, promote and otherwise use the Template as reasonably necessary to operate and promote the Wistudi Template Library and Platform.
The Creator also authorises Wistudi to grant other Wistudi Users the remix and reuse rights described in these Terms.
This licence does not allow Wistudi to sell the Creator's underlying original content as an independent product outside the Wistudi Platform unless the Creator separately agrees to that arrangement.
5. Licence granted to Users who remix a Template
When a User validly selects or remixes an approved Template through Wistudi, the original Creator authorises that User to use the Template as the basis for new content and to:
- copy the Template within Wistudi for the purpose of creating a new version;
- modify, adapt, redesign, reorganise, re-author, rewrite or expand it;
- remove, replace or add text, media, Pages, Blocks, activities or other elements;
- translate or localise the content;
- combine it with the User's own original material or other material they are lawfully permitted to use;
- publish and republish the resulting version on Wistudi;
- share and redistribute the resulting Wistudi content using available Wistudi sharing features; and
- use the resulting version for legitimate educational, teaching, training or professional purposes, subject to these Terms and applicable law.
The User's remix rights apply only to material the original Creator had the right to license and do not override third-party rights, external-provider terms or legal restrictions.
6. Ownership of remixed content
A User who remixes a Template owns the original material they independently add to the remix. The User does not acquire ownership of the original Creator's underlying material merely because it has been remixed, edited or combined with new content.
Each remixed version may become an independent Wistudi work for Platform purposes. Later changes to the original Template do not automatically update or overwrite an existing remix unless Wistudi expressly provides that functionality.
7. Attribution and author display
By submitting a Template, the original Creator agrees that Wistudi is not required to display the original Creator's name on every remix or derivative version.
A User who remixes a Template may be shown as the primary Creator or author of their resulting version. The original Creator understands that their name, profile or attribution may be omitted, reduced, changed in presentation, or shown only in Template history or other Platform metadata where Wistudi chooses to provide that information.
To the extent permitted by applicable law, the original Creator consents to the modifications, adaptations and attribution treatment reasonably necessary for the Template programme to operate. Nothing in these Terms removes rights that cannot lawfully be waived or limited.
8. Commercial and external use
The Template licence permits ordinary professional and educational use of a remix, including use by a teacher, tutor, trainer or other Creator in the course of paid professional activity.
Unless Wistudi or the original Creator expressly grants broader permission, a User must not take an original Template, make only trivial changes and sell or license the Template itself outside Wistudi as a standalone competing resource.
Wistudi may introduce additional commercial-use permissions, restrictions or licence options in the future. Any such terms will apply prospectively and will be clearly presented where relevant.
9. Third-party content and rights
The Creator must not submit a Template containing material they do not have sufficient rights to allow others to remix and republish.
This includes third-party images, music, publisher materials, worksheets, illustrations, video, branded content, licensed stock assets or other protected material where the Creator's licence does not permit onward reuse or adaptation.
Embedding or linking to external content such as YouTube does not transfer ownership of that external content and does not give remixing Users any rights beyond those allowed by the external provider, rights holder or applicable law.
The Creator confirms that they have all permissions reasonably necessary for the Template programme, including permission for Wistudi and other Users to exercise the rights described in these Terms.
10. Learner data, personal information and confidential material
Templates must not contain learner submissions, learner names, personal assessment responses, private communications, confidential information, unnecessary personal data or other material that should not be made available for public reuse.
The Creator is responsible for removing or anonymising such information before submitting content as a Template.
11. Template version and snapshot
An approved Template may be treated as a snapshot of the content at the time of approval. Changes to the Creator's original Flow or XP Video do not automatically change the approved Template unless Wistudi provides a feature or process for updating it.
Similarly, changes to or removal of the original Template do not automatically alter copies or remixes that were validly created earlier.
12. Withdrawal and removal requests
Once a Template has been approved and made available through Wistudi, the Creator may not unilaterally revoke the licences already granted through the Template programme.
The Creator may request that Wistudi remove the Template from future public use by contacting support@wistudi.com and providing the reason for the request. Wistudi will review the request and may remove, restrict or retain the Template as appropriate, subject to applicable law and these Terms.
Removal of a Template from future availability does not normally revoke or invalidate copies, remixes, derivative works or other uses that were validly created while the Template was available.
Wistudi may remove or restrict a Template at any time where reasonably necessary because of a valid intellectual-property or privacy complaint, safeguarding concern, security issue, legal requirement, policy violation, technical issue, quality concern or other material Platform reason.
13. Promotion of Templates
The Creator authorises Wistudi to use the Template title, thumbnail, preview images or video, screenshots, short excerpts, Creator display name where applicable, and other reasonable Template metadata to promote the Template Library and Wistudi through the Platform, website, newsletters, social media and other Wistudi communications.
This promotional permission does not transfer ownership of the Template to Wistudi.
14. Template remix credit rewards
Wistudi may offer credit rewards or other promotional benefits to the original contributor of an approved Template when another User completes an eligible remix or other qualifying Template action.
Any reward is a discretionary Platform incentive and is not a royalty, licence fee, revenue share, salary, commission or guaranteed form of compensation.
Wistudi may at any time introduce, modify, increase, decrease, suspend or discontinue a Template reward programme for future qualifying activity. Wistudi may also change the actions that qualify for a reward, introduce maximum limits or eligibility conditions, exclude particular activity, or replace a credit reward with another promotional benefit.
A reward amount offered or awarded at one time does not guarantee that the same reward will be available for future remixes. A Creator does not acquire a continuing entitlement to rewards merely because a Template remains available or has generated rewards previously.
Credits already validly awarded will not ordinarily be removed solely because the reward programme later changes. Wistudi may withhold, reverse or remove rewards associated with error, fraud, duplicate activity, self-remixing, coordinated artificial activity, account manipulation, policy violations or other misuse.
Template rewards have no cash value unless Wistudi expressly states otherwise and remain subject to the Credit Usage Policy.
15. No guarantee of use, attribution or reward
Wistudi does not guarantee that an approved Template will be featured, discovered, remixed, attributed in a particular way, generate engagement, generate credits or remain available indefinitely.
The Creator's permission to Wistudi and remixing Users is not conditional on a minimum number of views, remixes, rewards or other benefits unless Wistudi expressly agrees otherwise in writing.
16. Misuse of the Template programme
Users must not create duplicate accounts, self-remix for artificial rewards, coordinate false remixes, manipulate engagement, misrepresent authorship, remove legally required notices, or otherwise exploit the Template programme or reward system.
Wistudi may reject submissions, remove Templates, restrict remix access, withhold or reverse invalid rewards, or suspend accounts where misuse is identified.
17. Rights complaints
If a person believes a Template or remix infringes their rights, they may contact support@wistudi.com with sufficient information to identify the affected work and the disputed content.
Wistudi may temporarily restrict a Template or remix while a complaint is reviewed. Wistudi may require evidence of ownership, permission, licence terms or another lawful basis before restoring disputed material.
18. Changes to these Template Terms
Wistudi may update these Terms to reflect changes to the Template programme, remix features, rewards, legal requirements or Platform functionality. Updated Terms will display a revised “Last updated” date.
Material changes affecting future submissions or future reward activity may be communicated through the Platform, email or another reasonable method. Existing valid remix rights will not ordinarily be revoked solely because these Terms are later updated.
