4. Where information comes from

We may receive information directly from you, from another authorised User such as a Creator administering a learning experience, from your use of the Platform, from authorised service providers, from an integration you choose to use, or from lawful business and security records.

5. Why we use information

We may use personal information to:

  • create, authenticate and manage accounts;

  • comply with legal, regulatory, tax, accounting, safeguarding and contractual obligations; and
  • establish, exercise or defend legal rights.

6. Lawful bases

Depending on the processing activity, Wistudi may rely on one or more lawful bases under applicable data-protection law, including:

  • Contract, where processing is necessary to provide an account, Platform feature, purchase or service you request;
  • Legitimate interests, where reasonably necessary to operate, secure, improve and protect Wistudi, communicate with Users, prevent abuse, maintain records or support legitimate business operations, provided those interests are not overridden by your rights;
  • Consent, where we ask for a specific choice, such as certain analytics or marketing communications;
  • Legal obligation, where processing is required to comply with applicable law, regulatory requirements, tax, accounting or lawful requests; and
  • Vital interests or other lawful grounds, where applicable in exceptional safeguarding, safety or emergency circumstances.

Where we process special-category personal information, we will do so only where an additional lawful condition applies.

7. Public, shared and private information

Wistudi does not make private, sensitive, account, learner, activity, progress, assessment, transaction or other non-public personal information available to the general public or to unrelated Users of the Platform.

Information may be visible to another User only where it has been made available through an authorised feature, relationship, permission or sharing setting. For example, an authorised Creator may access appropriate Learner information needed for teaching, assessment, feedback, reporting, safeguarding or support.

Information you deliberately make public, such as public Creator information or information associated with content publicly listed in the Marketplace, may be displayed according to the applicable publishing settings and Terms. Making some information public does not make your other private account or activity information public.

8. Who we may share information with

Wistudi does not sell Users' private personal information to advertisers or unrelated third parties.

We may disclose or provide access to information only where reasonably necessary and lawful, including to:

  • authorised Users who need the information through a Platform feature or learning relationship;
  • hosting, infrastructure, storage, communications, analytics, payment, security, support and other authorised service providers acting for Wistudi;
  • integration providers where you choose to use a connected service;
  • professional advisers, insurers or auditors where reasonably necessary;
  • courts, regulators, law-enforcement bodies or other competent authorities where disclosure is legally required or lawfully requested; and
  • another entity in connection with a lawful merger, acquisition, financing, restructuring or sale of all or part of Wistudi's business, subject to appropriate safeguards.

We may also disclose information where reasonably necessary to prevent fraud, respond to security incidents, meet safeguarding obligations, protect a person from serious harm, or establish, exercise or defend legal rights.

9. Service providers and processors

Authorised service providers may process information only to the extent reasonably necessary to provide services to Wistudi and subject to applicable contractual, confidentiality, privacy and security requirements.

These services may include website and cloud hosting, database or file storage, email delivery, analytics, payment processing, security, support, event operations and business productivity tools.

10. International transfers

Wistudi operates internationally and authorised providers may process or store information outside the country where you are located. Where applicable law requires safeguards for an international transfer, Wistudi will use an appropriate lawful transfer mechanism or other permitted safeguard.

11. How long we keep information

Wistudi keeps personal information only for as long as reasonably necessary for the purpose for which it was collected or another lawful purpose. Retention periods may vary according to the category of information, account status, operational need and applicable legal obligations.

We may retain information for account operation, learner records, published content, publishing permissions, transactions, support, fraud and security investigations, moderation or copyright matters, safeguarding, backups, dispute resolution, legal claims, tax, accounting or regulatory obligations.

We will not retain personal information indefinitely merely because it may be useful in the future. Where information is no longer reasonably required, it may be deleted, anonymised or otherwise securely disposed of.

Closing an account or deleting content does not necessarily delete every associated record immediately. Information may remain temporarily in backups, logs or disaster-recovery systems, and information subject to a legal retention requirement may be retained for the required period.

12. Security

Wistudi uses reasonable technical and organisational measures intended to protect personal information against unauthorised access, loss, misuse, alteration or disclosure. No online system can guarantee absolute security.

Users are responsible for protecting their passwords and account credentials and should contact Wistudi promptly if they suspect unauthorised account access.

13. Children and younger Users

Users must be at least 16 years old to independently create a Wistudi account. Users under 16 may only access Wistudi through an approved parent-, guardian- or other lawful supervised arrangement where the required authority and consent have been obtained.

Where Wistudi processes information relating to younger Users or Learners, Wistudi will aim to apply appropriate privacy protections and minimise collection to information reasonably necessary for the authorised learning or Platform purpose.

14. Marketing communications

Where marketing consent is required, Wistudi will request it separately from service or account communications. You may withdraw marketing consent or unsubscribe from marketing communications at any time using the method provided in the communication or by contacting Wistudi.

Withdrawing marketing consent does not prevent Wistudi from sending necessary account, security, transaction, event or service messages.

15. Website analytics and cookies

Wistudi uses cookies and similar technologies for functions such as language preferences, consent management and website analytics. Non-essential analytics are controlled in accordance with applicable requirements and User choices.

More information is available in the Wistudi Cookie Policy.

16. AI-assisted features

Where personal information or User Content is processed through an AI-assisted feature, Wistudi will process it according to the applicable feature, this Policy, product controls and applicable law. Users should not submit unnecessary sensitive or confidential personal information to AI-assisted features.

17. Your data-protection rights

Depending on applicable law and the lawful basis used, you may have rights including access, correction, erasure, restriction, objection, data portability and withdrawal of consent.

To exercise a privacy right, contact support@wistudi.com. Wistudi may need to verify your identity or authority before responding. Rights are subject to applicable legal limits and exemptions, including protections for other people's personal information and confidential or security-sensitive information.

You may have a right to object to certain processing based on legitimate interests and to direct marketing.

18. Privacy complaints

If you have a concern about how Wistudi handles personal information, please contact Wistudi first so the issue can be reviewed. You may also have the right to complain to the UK Information Commissioner's Office or another competent data-protection authority.
